Terms and Conditions

These Terms and Conditions apply to all work carried out by Sunlight Garden Services. By accepting a quotation or allowing work to commence, you agree to these terms.

1. Quotations

  • All quotations are valid for 30 days from the date issued, unless stated otherwise in writing.
  • Quotations are based on the information available at the time of inspection. Hidden or unforeseen issues (buried debris, damaged root systems, structural defects) may result in additional charges. These will be discussed and agreed with you before any extra work is carried out.
  • Verbal quotations are provided for guidance only. Written quotations take precedence.

2. Deposits

  • A 10% deposit may be requested to secure your booking.
  • For projects where we order materials on your behalf (paving, turf, timber, plants), an additional deposit or full payment for those materials may be required before work begins.
  • Deposits are non-refundable once work has commenced or materials have been purchased specifically for your project.

3. Payment Terms

  • Domestic customers: full payment is due on the day the work is completed. We accept bank transfer, cash, and card (via link).
  • Commercial customers: payment is due within 30 days of the invoice date, unless a different arrangement has been agreed in writing.
  • Ownership of any supplied materials remains with Sunlight Garden Services until full payment has been received.

4. Late Payments

  • For domestic invoices, interest may be charged on overdue balances at 4% above the Bank of England base rate, calculated daily from the due date.
  • For commercial invoices, we reserve our statutory rights under the Late Payment of Commercial Debts (Interest) Act 1998: interest at 8% above the Bank of England base rate, plus a fixed recovery charge (£40 per invoice up to £999.99, £70 up to £9,999.99, £100 above £10,000).
  • We may suspend any ongoing or future work until outstanding balances have been cleared, and we may recover reasonable costs incurred in collecting overdue payments.

5. Changes to the Work (Variations)

  • Any additional work requested after the quotation has been accepted is treated as a variation and may incur additional cost and time.
  • We will provide a revised price for the variation and, where reasonably possible, obtain your written approval before proceeding.

6. Waste Removal

  • Green waste, soil, rubble, and other materials will only be removed where this is stated in the quotation.
  • If additional waste is discovered during the works (buried rubble, old concrete, previous landscaping fabric), removal will be charged as a variation.

7. Weather and Delays

  • Work may be delayed by adverse weather (heavy rain, frozen ground, high winds, snow) or other circumstances beyond our reasonable control.
  • We will make every effort to reschedule affected work at the earliest practicable date and will keep you informed.

8. Customer Responsibilities

  • You must provide safe and reasonable access to the work area on the agreed dates.
  • You are responsible for identifying and informing us in writing of any hidden services on your property: underground cables, water and gas pipes, drains, irrigation, cesspits, or private connections.
  • We are not liable for damage to undisclosed services.
  • Delays caused by restricted access, unavailable services, or missing information may result in additional charges.

9. Workmanship Guarantee

  • We provide a workmanship guarantee of between one and two years depending on the type of work:
    • 1 year: {{GUARANTEE_1YR_WORK}} (typical example: planting, turfing, seasonal maintenance)
    • 2 years: {{GUARANTEE_2YR_WORK}} (typical example: patios, fencing, decking, hard landscaping)
  • The guarantee covers defects arising from our workmanship only.
  • The guarantee does not cover damage caused by weather events, ground movement, misuse, accidents, lack of maintenance, third-party interference, pets, or natural wear and tear.

10. Materials and Plants

  • Natural products such as timber, paving, turf, and plants vary in colour, texture, and appearance. Small differences from samples or previous batches are normal and are not defects.
  • We cannot guarantee the survival of plants, turf, or other living materials, as factors beyond our control (watering, weather, pests, soil conditions after handover) affect their establishment.
  • Aftercare advice will be provided where relevant. Following it is your responsibility.

11. Damage and Liability

  • We take reasonable care while carrying out all work and carry Public Liability insurance of £{{PLI_AMOUNT}}.
  • We will not be liable for damage caused by hidden defects, undisclosed underground services, pre-existing structural issues, or circumstances beyond our reasonable control.
  • Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for any other liability which cannot lawfully be limited.

12. Consumer Right to Cancel (14-day cooling-off)

  • If you are a domestic consumer and booked our services off-premises (by phone, email, or during a home visit), you have the right to cancel the contract within 14 days of acceptance, without giving a reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

  • If you ask us to begin work within the 14-day period and later cancel, you must pay for the work carried out and for any materials already purchased on your behalf up to the point of cancellation.

13. Cancellations and Postponements (outside the cooling-off period)

  • Please provide as much notice as possible if you need to cancel or postpone booked work.
  • 48 hours or more notice: no charge.
  • Less than 48 hours notice: we may charge up to 50% of the day’s booked labour to cover the lost slot.
  • On the day cancellation or no access on arrival: we may charge the full booked labour for that day, plus any materials already ordered.

14. Complaints

  • If you are unhappy with any aspect of our work, contact us within 14 days at 07510 796808 or samgood42 @ hotmail . co . uk.
  • We will acknowledge your complaint within 5 working days and aim to resolve it within 30 days.

15. Data and Privacy

We handle your personal data in accordance with our Privacy Policy.

16. Governing Law

These Terms are governed by the laws of England and Wales, and any disputes fall under the exclusive jurisdiction of the courts of England and Wales.

17. Acceptance

Acceptance of our quotation, payment of a deposit, or allowing work to commence confirms that you have read and accepted these Terms and Conditions.
